Independent Forensic Assessment into cause of Financial Distress

Kahamelo (mandated by D&T Trust Liquidators) carried out an independent forensic assessment on a South African Construction Company’s available financial and other information to determine the cause of the company’s financial difficulties and distress prior to business rescue and subsequent liquidation.
Clyde & Co Appointed Business Rescue Matter

Kahamelo (mandated by Clyde & Co) drafted a memorandum for one of a Furnace Services Company’s major suppliers, which contained a review of the company’s business rescue plan, and which indicated risks and concerns identified.
Expert Witness during Arbitration Insolvency Matter

Kahamelo (mandated by the D&T Trust Liquidators) conducted a forensic investigation into a South African Mining Services Contractor’s financial affairs prior to and during its business rescue. Kahamelo reported on whether the company’s directors contravened Section 424 of the Companies Act. Kahamelo also assisted D&T Trust in drafting a report to SARS regarding the business rescue practitioner’s conduct. Johan testified as an expert witness during the Arbitration proceedings (Arbitrator: Advocate Louis Harms, a former deputy president of the South African Supreme Court of Appeal).
Financial Forensics for Danish Maritime Services Company (Denmark, in liquidation)

In consultation with Bowman Gilfillan and Advocate Michael Fitzgerald (SC), Kahamelo assisted a Danish Maritime Services Company with financial forensic procedures, which included detailed financial, accounting treatment, and tax analyses into various agricultural transactions, during litigation with a South African grain company.
Valuation of Assets in the USA

Kahamelo assisted a South African-founded Global Sports Nutrition and Dietary Supplements Brand in conducting an independent valuation of its North American assets, including its website domain, inventory, and customer list, in accordance with the International Valuation Standards.
Regional Court Valuation (South African Private Investment Group)

Kahamelo was mandated by Sulandi du Plessis Attorneys to perform an independent valuation of a group of companies, including non-local companies. Kahamelo utilised the Market Approach and the Income Approach (P/E Multiple Method) to value the companies.
High Court Valuation (South African Corporate Finance Advisory & Private Equity Firm)

In consultation with Crowe Forensics, Kahamelo quantified and verified the accrual in the parties’ estates and performed an independent valuation of a group of 54 companies included in the parties’ estates using various valuation methodologies accepted by the High Court. Johan further assisted Advocate Nigel Riley during the High Court proceedings on valuations.
Valuation of Retail Group for Arbitration Proceedings

Kahamelo (mandated by Mendelson Attorneys Inc.) assisted with valuing a Gauteng-based Transport and Warehousing Services Group, providing an opinion on the International Financial Reporting Standards (IFRS) treatment of an outstanding international debt, and reviewing the appropriateness and accuracy of a previous valuation performed for the purpose of arbitration proceedings.
High Court Appointed Panel of Valuers

Kahamelo was selected by Clyde & Co Attorneys to form part of a panel of three valuers, which was ordered by the High Court of South Africa to perform the valuation of the shares of two Sister Companies operating Specialist Addiction Recovery Facilities in Cape Town, with international revenue streams as part of a Settlement Agreement between the seller and buyer.
Supreme Court Valuation of South African Private Investment Holding Company

Kahamelo (mandated by Weavind & Weavind Attorneys) performed an independent valuation of a South African Private Investment Holding Company and its six subsidiaries in terms of Supreme Court Order 14080/2018 and 1250/23. Johan worked with Advocate Sarel Wagener SC on the matter and compiled an independent expert valuation report.
